These Terms govern your use of the Photoelectric consumer mobile application and the energy services offered through it in India. Please read them before creating an account or placing an order. Specific services, prices and warranties will be stated in the quotation or order you accept. Your statutory consumer rights remain unaffected.
The App is operated by Photoelectric Solar System Pvt Ltd (Photoelectric, we, us), CIN: U29248KA2015PTC084207, with registered office at Plot No 124, vaishnavi Colony, Shiv Nagar North, Bidar-585401, Karnatak, Customer support: sales@photoelectric.in, Telephone: +91 8879 100 200, Support hours: 9:00 am – 6:00 Pm . Grievance Officer: Veershetty Kulase, Director, sales@photoelectric.in, +91 9136392517, Plot No.124, Vaishnavi colony, Shiv Nagar North, Bidar-585401, Karnataka. Privacy contact and Privacy Notice: +91 9136392517, https://www.photoelectric.in/privacy.php These details must also appear in the App’s Help or Legal section.
You accept these Terms by selecting the unticked acceptance box and submitting registration, or through another clearly identified affirmative acceptance step. You must be at least 18 years old and competent to contract. If you act for a society, landlord, business or other customer, you must have authority; creating an account does not itself authorise you to approve expenditure, access another person’s electricity account or commission electrical work. Provide accurate contact and site details, keep them updated and protect your password and OTP. Do not share another person’s bills, account credentials or personal information without authority. Tell support promptly about suspected misuse. We may use proportionate verification and security controls. You are not automatically liable for every unauthorised transaction; responsibility depends on the facts and applicable law. Download the App only from our identified distribution channels.
Depending on the features actually enabled and service availability at your location, the App may offer enquiries, solar or battery assessments, electricity bill analysis, energy audits, installation requests, equipment enquiries, O&M or AMC bookings, service tracking, monitoring and energy or carbon estimates. Availability in the App does not mean every service is available at every site. Features not enabled or expressly ordered are not promised.
Photoelectric’s role and the contracting service provider will be clearly identified before a paid order. Where Photoelectric sells or provides the service, it remains responsible for its contractual and statutory obligations, including work carried out through its subcontractors. Where an independent seller or provider contracts directly with you, its identity, contact details, scope and applicable terms will be disclosed before purchase. We do not use a general third-party disclaimer to remove duties imposed on us by law.
App calculations, initial recommendations and quotations based on uploaded information are preliminary unless expressly confirmed as final. Generation, savings, payback and carbon estimates depend on assumptions such as tariff, load, weather, shading, roof condition, equipment, grid availability, export settlement and maintenance. The relevant estimate should identify material assumptions and exclusions. A forecast does not guarantee a zero electricity bill, uninterrupted supply, subsidy, approval or financial return. An express performance commitment in an accepted order will apply according to its terms.
We will identify any need for site survey, structural assessment, electrical inspection or additional information before confirming the relevant work. You should not undertake wiring, rooftop work, battery changes or protection-setting changes solely from App guidance. Statutory approvals, utility permissions, net metering and scheme eligibility require project-specific verification; the App does not grant them.
An enquiry, provisional appointment, automated acknowledgement or payment receipt does not by itself confirm a project contract. Before purchase we will provide the service provider, itemised scope, total price and taxes, material exclusions, advance and balance payment terms, anticipated schedule, dependencies, cancellation and refund terms, warranty and complaint contacts. You may review and correct details before confirming. The contract forms when the identified provider expressly accepts the order and sends confirmation, unless the checkout clearly states a different formation step.
If we cannot accept an order after taking payment, we will inform you and refund the amount for the unaccepted order without a cancellation deduction. We will not increase an accepted price or substitute material equipment without your agreement. Extra work requires a clear variation describing the scope, cost and timing before acceptance, except immediate reasonable safety measures where prior consent is impracticable and law permits. A consumer-unfavourable change will not be imposed retrospectively.
Provide accurate site information and disclose known electrical faults, roof hazards, access restrictions, occupancy limitations and required owner or society approvals. Arrange lawful, safe access at the agreed time. We remain responsible for reasonable professional inspection and our own safety duties; your disclosure obligations do not excuse negligent work. Any survey or visit fee, failed-access charge or rescheduling fee must be disclosed before booking and reasonably reflect the agreed service.
Appointments and completion dates depend on the confirmed order, access, permissions and agreed dependencies. We will notify material delays and revised dates. If delay defeats the agreed purpose or gives you a right to cancel under law or the order, you may exercise that right. Workers must have the qualifications and licences required for their work. Do not touch exposed wiring, bypass protection or re-energise isolated equipment. The App is not an emergency response service. For a dangerous electrical condition, keep clear and contact the relevant emergency service, utility or qualified professional.
Prices and payment milestones must be visible before purchase, including applicable taxes, delivery, installation, visit fees and other mandatory charges. No paid add-on will be selected automatically. Pay only through identified official channels or the account in an authentic invoice. We will provide an invoice or receipt and a contact for payment discrepancies. Where a payment provider processes payment, its disclosed transaction terms also apply, without reducing our responsibility for our own charges or refunds.
We will not ask you to disclose an OTP, PIN or password to receive a refund. Report suspicious demands through the official support contact. Any finance or insurance product, if offered, requires separate lender or insurer disclosures and acceptance; these Terms do not create a loan, insurance contract, power purchase agreement or authority to switch your electricity supplier.
A subscription, AMC or monitoring plan must state duration, included work, exclusions, price, billing frequency, cancellation and renewal terms. No automatic renewal or recurring debit is authorised merely by accepting these Terms. Any recurring mandate requires separate explicit authorisation and applicable payment safeguards. Cancelling a plan must be reasonably accessible. Future renewal prices require advance notice; existing paid entitlements are governed by the accepted plan.
The cancellation and rescheduling policy applicable to your order must be shown before confirmation and supplied with the order record. There is no blanket no-refund rule. Where cancellation is permitted, any charge must be disclosed, lawful and reasonable. We will not impose cancellation charges unless equivalent responsibility applies when we cancel unilaterally, as required by applicable law. There will be no cancellation deduction for our inability to fulfil an accepted order, subject to amounts lawfully payable for separately accepted conforming work already completed.
For a partly completed project, we will provide a transparent account of accepted work, conforming goods supplied, any specifically agreed lawful nonrecoverable commitments and the unspent advance. Custom-made equipment does not remove remedies for defects, misdescription or our breach. Where goods are defective, deficient, spurious, misdescribed, or delivery is late in circumstances giving a legal remedy, applicable return, repair, replacement and refund rights remain available. Specific remedies depend on the order and law; a warranty expiry does not automatically extinguish statutory rights.
For an accepted refund, we will initiate payment within seven business days, or sooner where law requires, ordinarily to the original payment method. We will provide a reference and expected processing information. Bank or payment-provider posting times may vary; we will assist if the credit is delayed. Do not share card security details to pursue a refund. No refund administration fee applies unless lawfully disclosed and accepted before purchase.
The order will identify equipment make and model, delivery and installation responsibilities, specifications, testing and commissioning, title and risk transfer where relevant, warranty issuer, duration, service response and material exclusions. A delivery receipt confirms receipt and apparent condition; it does not waive latent defects, safety failures or consumer remedies. Report apparent damage promptly with reasonable evidence where available; inability to meet an informal reporting window does not by itself extinguish a legal claim.
We will address defects attributable to our goods or services in accordance with the order and applicable law. Manufacturer warranty terms may apply to equipment, and we will provide available documentation and reasonable claim assistance. We remain responsible for our own supply and workmanship obligations. Misuse, unauthorised modification or external damage may affect a warranty only to the extent relevant to the problem and consistent with law. Do not perform unsafe repairs to preserve evidence; safety comes first.
If monitoring is enabled, readings may be delayed, incomplete or affected by communications, device calibration, configuration or third-party systems. We will exercise reasonable care in presenting data and identify known material limitations. App readings are informational unless the relevant service expressly provides certified measurement. For utility billing, the legally recognised meter and applicable billing process govern. Contact us about material discrepancies; App limitations do not excuse failure to meet a paid accuracy or monitoring commitment.
An App alert does not guarantee detection of every fault, a continuous staffed response or physical equipment shutdown. The service plan will state any response commitment. Keep local protection, inspection and maintenance in place. You may connect only devices and utility or inverter accounts you are authorised to use. We will request necessary access and explain its scope; do not submit third-party passwords through unofficial channels. Disconnecting an integration stops future access subject to technical and lawful retention limits.
Remote switching, inverter control, battery operation or export-limit changes, if ever offered, require separate explicit authorisation and documented limits and safeguards. These Terms alone do not authorise remote control of your equipment. Data exports and integrations remain subject to your rights and the disclosed access arrangements. Carbon estimates do not create carbon credits, certificates or ownership transfers without a separate express agreement.
Our separate Privacy Notice explains what registration, billing, site, device, consumption and usage information we process, why, recipients, retention, security, rights and contact channels. These Terms do not replace that notice or provide blanket consent for unrelated processing. We comply with applicable Indian privacy, cybersecurity and data protection provisions as they come into force, including relevant provisions of the Digital Personal Data Protection Act and Rules on their notified timetable.
Camera, photo, location, notification and other device permissions will be requested only for the relevant enabled function with an explanation. Optional permissions and promotional consent should remain optional where they are not necessary to provide the requested service. Where you withdraw permission, the related feature may no longer function; unrelated access should remain available where practicable. Your uploaded electricity bills and site records will not be treated as public marketing content.
We may send necessary account, security, order, payment and service messages through appropriate disclosed channels. Marketing calls, SMS, email, messaging or push promotions require the applicable lawful basis, telecom compliance and a separate opt-in where required. You may withdraw optional marketing choices through the stated controls without cancelling an unrelated service. App account deletion does not itself cancel an active order or recurring payment mandate; we will explain how to cancel those separately.
Use the App lawfully. Do not impersonate others, submit fraudulent bills, interfere with monitoring, introduce malware, access another account, scrape personal information or disrupt systems. You may report concerns, publish honest reviews and exercise lawful consumer rights. Any review moderation must use fair published rules, disclose material incentives and avoid misleading suppression. Do not upload content you lack authority to share.
You retain rights in your uploaded content and grant us only the limited rights reasonably necessary to process it for the requested services, support and legal compliance, as explained in the Privacy Notice. Public advertising, testimonials and identifiable site photographs require separate permission where required. We retain our App software, marks and original materials and grant you a limited right to use the App for its intended purpose. Mandatory legal rights and rights in your own information are preserved.
We will use reasonable care to maintain the App and give reasonable notice of planned interruptions where practicable. Internet, device and third-party outages may affect access. Where an outage materially affects a paid service, the order and your legal remedies continue to apply; an availability disclaimer does not cancel those obligations. Events beyond reasonable control may justify affected delays, but do not automatically permit us to retain payment for services we cannot supply.
We may restrict affected access for a credible security risk, fraud, unlawful activity or material breach. We will act proportionately, give reasons and an opportunity to respond where practicable, and provide a review route through support. Urgent protective action may come first. Suspension does not automatically forfeit prepaid amounts or prevent a complaint, refund request or lawful data request. You may stop using the App and request account closure; we will explain ongoing orders, refunds and legally required record retention.
We are responsible for our breach, negligence, misrepresentation and other liability imposed by applicable law. You remain responsible for your own unlawful acts and material misuse. These Terms impose no blanket consumer indemnity, automatic liability for all account use, or waiver of product liability. We are not responsible for losses to the extent caused solely by circumstances for which we have no legal responsibility, but remain responsible for reasonable mitigation and our own contribution.
Nothing excludes or restricts rights or liability that cannot lawfully be excluded, including applicable remedies for defective goods, deficient services, unfair trade practices, fraud, wilful misconduct, negligent injury and unlawful data handling. We do not impose an App-wide monetary cap that overrides your order value or statutory remedies. No clause makes our records conclusive or prevents you from challenging a transaction or seeking relief.
Contact support or the Grievance Officer in clause 1 with your order or account reference, the issue and the remedy requested. Do not send passwords or payment PINs. We will acknowledge consumer complaints within 48 hours and redress them within one month, or within a shorter mandatory period. We will provide a tracking reference and explain escalation if the matter remains unresolved. Technical repairs may require scheduling, but this does not suspend applicable grievance duties or your remedies.
Indian law governs. We encourage direct resolution but do not require compulsory arbitration, an internal appeal or a Mumbai-only court as a condition of exercising consumer rights. You may approach a consumer commission, regulator or other forum having jurisdiction under applicable law. You may also use the National Consumer Helpline at https://consumerhelpline.gov.in. Nothing shortens a statutory limitation period or prevents urgent relief.
We may update these Terms for lawful service or regulatory changes, giving reasonable advance notice of material changes and access to the revised version. Fresh express acceptance will be obtained where required, including before applying materially changed contractual obligations. Continued browsing alone does not authorise a new charge, recurring mandate, data use requiring consent or retrospective reduction of rights. Accepted orders remain governed by their accepted terms unless a lawful change is expressly agreed.
Mandatory law prevails over these Terms. A clearly accepted service order governs its specific scope, price, schedule and warranty; any material departure from these Terms must be prominently disclosed and expressly accepted and must not remove mandatory consumer protections. The Privacy Notice governs its own subject without authorising inconsistent processing. An invalid provision is severed to the extent possible, and failure to enforce a term immediately does not waive lawful rights.
